Terms of Service
Note: this document is a plain-English draft and is pending review by legal counsel. It is not legal advice.
These Terms of Service ("Terms") are an agreement between TryBuzzCall LLC ("we," "us") and the business that signs up for BuzzCall ("Shop," "you"). They cover the BuzzCall missed-call text-back service, its pilot, and this website. The SMS Terms below also apply to anyone who receives BuzzCall text messages. By starting a pilot, subscribing, or using BuzzCall, you agree to these Terms and to our Privacy Policy.
1. The service
BuzzCall is for businesses only, not for personal or household use. When a call to your business goes unanswered, BuzzCall texts the caller back from a number set up for your business, collects the caller's name and problem, offers up to 3 of your open appointment times, can request a booking deposit (default $49) through Stripe that is credited to the customer's bill, and sends you an alert by text. We handle setup and carrier (A2P 10DLC) texting registration with information you provide. Features may change over time.
2. Free pilot and free trial
Pilot. We may offer a free 14-day pilot (currently for the first 10 Georgia shops) that we set up with you without a payment method. Pilots are free of BuzzCall subscription, setup, and per-paid-lead fees, are provided as-is for evaluation, and may be limited or ended at our discretion. A pilot set up without a payment method does not turn into a paid subscription unless you choose a paid plan.
Free trial at signup. If you sign up online, you choose a monthly or annual plan and enter a card. Your plan starts with a free trial (currently 14 days, as shown at checkout). The trial converts to a paid subscription automatically and your card is charged for the first billing period when the trial ends, unless you cancel before the trial ends. We will remind you by text before the trial ends (currently about 3 days before). If no valid payment method is on file when the trial ends, the subscription is cancelled. Setup fee. A one-time setup fee (currently estimated at $99) applies to monthly plans only. It is waived for our first 10 founding shops and on annual plans. It is not charged at signup: it is added to your first invoice after your free trial ends, and if you cancel during the trial you pay no setup fee. Whether it applies to you is shown at checkout.
Carrier registration fees, if any, will be disclosed to you before they are charged. Customer deposits collected during a pilot are handled as described in Section 5.
3. Subscription and billing
- Plans. Plans and prices are shown on our website or in your order (currently a base plan starting at $49/month, plus a per-paid-lead fee, with a one-time setup fee estimated at $99, waived for our first 10 founding shops and on annual plans, and charged only after your free trial). Prices are estimates until confirmed in your order, and may vary by setup.
- Per-paid-lead fee. A per-paid-lead fee (currently estimated at $12 per lead, as set in your order) applies only when a caller books an appointment through BuzzCall and pays the booking deposit. No fee applies to calls, texts, callback requests, unpaid or expired holds, or bookings without a paid deposit. Depending on your setup, the fee is either deducted automatically from the deposit as a platform fee when the deposit is paid through your connected Stripe account, or totaled and invoiced to you monthly.
- Payment and automatic renewal. The base plan is billed in advance, monthly or annually, through Stripe. Your subscription renews automatically at the end of each billing period for the same term (monthly or annual) at the then-current price until you cancel. Your billing date is the day your paid period starts (the day your trial ends, if you had one), so there is no partial first month. You authorize us to charge your payment method for each renewal.
- Plan changes. You can switch between monthly and annual billing. A switch starts a new billing period on the day you switch. Unused time on your old plan is credited (prorated) against the new plan: when you move to annual, the difference is charged right away; when you move to monthly, any remaining credit is applied to your future invoices. During a free trial, a plan change takes effect without a charge until the trial ends.
- Manage your billing. You can update your card, see invoices, and cancel in the self-service billing portal linked from your account or our texts, or by contacting us.
- Price changes. We will give you at least 30 days' notice before a price change takes effect at your next renewal.
- Taxes. Prices exclude applicable taxes, which you are responsible for.
- Failed payments. If a payment fails, we will text you a link to update your card, and Stripe may retry the charge. While a payment is past due, we may limit the service: your callers may receive only a short "please call back" text, without booking or deposits, until the payment goes through. If it stays unpaid, the subscription may be cancelled.
4. Cancellation
You can cancel at any time in the billing portal or by contacting us at [support email]. Cancellation takes effect at the end of your current paid billing period (monthly or annual), and you keep access until then; it does not renew after that. We do not give partial or prorated refunds for the unused part of a billing period. Fees already paid are non-refundable except where required by law or stated in your order. To avoid being charged when a free trial ends, cancel before the trial end date. When the service ends, we stop texting from your BuzzCall number and, if you request it, help you port or release the number where possible.
5. Customer deposits and your refund policy
- Deposits are paid by your customers through Stripe and are credited to the customer's bill. They are not a fee to you. If your setup deducts the per-paid-lead fee from a deposit (Section 3), the rest of the deposit is paid to your connected Stripe account, and the customer's bill is still credited with the full deposit.
- You are responsible for your own refund policy and for honoring it. Our Customer Deposit Refund Policy is the default shown to your customers unless you give us your own policy to use. You must make sure the policy you use is accurate and lawful for your business.
- You are responsible for issuing refunds you owe, responding to customer questions and payment disputes (chargebacks), and any related Stripe fees, unless we agree otherwise in writing.
- BuzzCall flags payments that arrive after a slot hold has expired; you are responsible for rescheduling or refunding those customers.
6. Your responsibilities
- Provide accurate business information, including for carrier registration, and keep it up to date.
- Use BuzzCall only to reply to people who called or texted your business, for the job they contacted you about. Do not use it to send marketing or promotional messages unless you have separate, legally valid consent and we have agreed to it.
- Comply with all laws and rules that apply to you, including the Telephone Consumer Protection Act (TCPA), CAN-SPAM where relevant, state consumer and telemarketing laws, and carrier and CTIA messaging guidelines.
- Review the message wording we set up for you, and tell us promptly about anything inaccurate.
- Answer customers who reply asking for help, and never text anyone who has opted out.
- Keep your login details and admin password confidential.
- Remember that BuzzCall is not an emergency service. Urgent flags are best-effort and do not replace calling 911 or your own emergency procedures.
7. Acceptable use
You may not use BuzzCall to:
- send spam, unsolicited bulk messages, or messages to purchased, rented, or scraped lists;
- send content that is illegal, fraudulent, deceptive, harassing, hateful, or sexually explicit, or that promotes illegal drugs, or that is otherwise prohibited by carriers (including restricted categories such as cannabis, firearms, and gambling);
- impersonate another person or business, or hide who is sending messages;
- phish, distribute malware, or collect sensitive data such as full card numbers or passwords by text;
- interfere with, reverse engineer, overload, or try to get around the security of the service.
We may remove content, block messages, or suspend service to stop a violation or carrier complaint.
8. Third-party services
BuzzCall relies on third parties, including Twilio (calls and texting), Stripe (payments), mobile carriers, and, if enabled, OpenAI (AI-assisted replies). Their services are governed by their own terms, and we are not responsible for their outages, delays, or decisions, such as a carrier filtering messages or rejecting a registration. If you enable AI-assisted replies, replies may occasionally be inaccurate, and you are responsible for the information you ask us to give your customers.
9. Data
You own your business data and your customers' information. You give us permission to use it to provide, secure, and improve BuzzCall as described in our Privacy Policy. We will not sell it or use your customers' numbers for our own marketing. You are responsible for having the right to provide information you give us.
10. Disclaimers
BuzzCall is provided "as is" and "as available." To the fullest extent allowed by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that every call will be caught, every text delivered, any number of bookings or deposits, or that the service will be uninterrupted or error-free.
11. Limitation of liability
To the fullest extent allowed by law: (a) neither party is liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, jobs, or data, even if advised of the possibility; and (b) TryBuzzCall's total liability for all claims relating to BuzzCall is limited to the amount you paid us for BuzzCall in the 12 months before the event giving rise to the claim, or $100 if you have paid nothing (for example, during a pilot). Some jurisdictions do not allow certain limits, so some of these may not apply to you.
12. Indemnity
You will defend and indemnify TryBuzzCall against third-party claims, fines, and costs arising from your messages and customer communications, your refund policy and handling of deposits, your violation of these Terms, or your violation of law (including the TCPA).
13. Suspension and termination
We may suspend or end your access if you breach these Terms, fail to pay, create legal or carrier risk, or if required by a carrier or provider. Where reasonable, we will give notice first. Sections 5, 9, 10, 11, 12, and 14 survive termination.
14. Governing law
These Terms are governed by the laws of the State of Georgia, USA, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Fulton County, Georgia, and both parties consent to those courts.
15. General
We may update these Terms by posting a new version here and changing the "Last updated" date; material changes take effect 30 days after notice to active Shops. Continued use after that means you accept the changes. These Terms, together with any order you sign, are the entire agreement on this subject. If any part is unenforceable, the rest stays in effect. You may not assign these Terms without our consent. Failure to enforce a provision is not a waiver.
16. SMS Terms
These SMS Terms apply to anyone who receives text messages through BuzzCall.
- Program name: BuzzCall Missed-Call Text-Back, operated by TryBuzzCall on behalf of participating local plumbing and HVAC businesses. Each message identifies the business you called.
- How you opt in: by calling a participating business and leaving the call unanswered, or by texting that business's number. That starts a conversational text reply about your call. See How text consent works. Shop owners and staff opt in to booking alerts by giving us their mobile number during setup.
- Message types: missed-call follow-ups (asking your name and what you need), appointment time options, booking and deposit links, booking and deposit confirmations, and service updates about your job. Shop owners receive new-lead and booking alerts. We do not send marketing messages through this program.
- Message frequency varies depending on your conversation with the business.
- Message and data rates may apply.
- Reply STOP to opt out, HELP for help. You can also reply UNSUBSCRIBE, CANCEL, END, or QUIT to opt out. You will receive one message confirming you have opted out. Reply START to opt back in. For help, you can also contact us at [support email] or [phone].
- Carriers are not liable for delayed or undelivered messages.
- Consent to receive texts is not a condition of any purchase. You can always call the business directly instead.
- Privacy: see our Privacy Policy. Mobile numbers and SMS opt-in data are not shared with or sold to third parties or affiliates for marketing purposes.
